Golden Creative is an incubation, co-working and business hosting center, which aims to leverage, implement and enhance projects in the area of Communication Technology, Information and Electronic and related services for the creation, development and consolidation of companies, through an integrated offer of spaces, equipment and services. The present regulation aims to define rules and conditions of access and operation of the Co-work service/space, the Virtual Office service, Individual Secretary Rental and Open Space Office Rental of Golden Creative, as well as to define application procedures and use of all services.
I – DEFINITIONS
MANAGER: Ivandro de Jesus Miranda Alves
USER: Entrepreneurs, as long as they are constituted as a Natural or Legal Person, holders of innovative ideas or projects with entrepreneurial potential, who aim to set up at Golden Creative.
COMMON SPACES: All spaces that will be shared by users and are intended for collective use.
II – OBJECTIVES AND SERVICE DESCRIPTION
The Co-work service, the Virtual Office service, Individual Secretary Rental and the Open Space Office Rental service from Golden Creative, have as their main goal to support companies and professionals who operate in the Communication Technologies, Information and Electronic and related services markets, in the process of development and consolidation of their projects and activities, providing access to services, work space and integrated solutions that facilitate their implementation and growth in the market.
Besides the main goal, Golden Creative provides the privileged access of resident companies to a wide range of entities and partners, thus providing excellent opportunities for growth based on synergies and networking.
The Co-work service comprises the use of a workstation, in an air-conditioned area, with access to electricity, wi-fi network and use of common spaces, as well as a meeting room (by contracted modality), including cleaning service.
The Virtual Office service includes the use of Golden Creative’s address for head office purposes, sending correspondence and, if so desired, may also include the use of the meeting room.
The Open Space Office Renting service includes the use of office rooms in spaces under concession or managed by Golden Creative, for permanent and independent physical installation of companies or services.
III – LOCATION, FACILITIES AND SERVICES ARTICLE 1
(LOCATION)
Golden Creative is located at Rua Homens do Andar, no94, Loja – A, in Loulé (8100-710).
ARTICLE 2
(FACILITIES)
Golden Creative has the following facilities, equipment and installations, available according to the contracted modality
- 12 workstations in “Co-work” (Individual Desks and Offices in open space);
- Private meeting room with capacity for 8 people;
- Waiting area/Open space meeting room with capacity for 2 people;
- Unlimited wi-fi internet;
- Sanitary facilities;
- Access to an equipped kitchen;
- Free parking;
- Use of electrical network, water and sanitation;
- Security equipment;
- Signage and furniture.
ARTICLE 3
(SERVICES)
The support provided by Golden Creative consists of the following services*:
(a) Provision of the common spaces and equipment characterized under the terms of the previous clause;
b) Basic secretariat services, namely
- Reception of correspondence; – Photocopying services;
- Cleaning services.
c) Support in the promotion of the activity, products and services through events; e) Support in the structure of the communication strategy;
f) Tax and commercial address;
g) Access to specialized consulting (Online Marketing) under the terms and
and conditions to be defined case by case. - Available according to the type of service contracted.
IV – ACTIVITIES ARTICLE 4
(ACTIVITIES)
1 – The installation in Golden Creative will follow the principles of non-discrimination, with regard to the activities to be developed by users, without prejudice to the right of Golden Creative to refuse the installation of companies whose purpose is contrary to the objectives and duties of the manager.
2 – Any installation in Golden Creative requires prior approval by the Manager.

(CONTRACTS FOR USE/ASSIGNMENT AND PROVISION OF SERVICES)
The Users and the Manager will enter into a Services Agreement, in which the agreed-upon conditions are described.

The Users and the Manager will enter into a Service Provision Agreement, whereby the agreed upon conditions are described.
ARTICLE 6
(PRICE AND TERMS OF PAYMENT)
The payment due for the use of the facilities and services described in these regulations and in the contract will be invoiced at the beginning of each month in which they are rendered, and will be carefully made by the tenth of that month.
ARTICLE 7
(CESSION OF SPACES TO THIRD PARTIES)
The User is expressly forbidden to rent, sublet or cede, in whole or in part, the assigned space, under penalty of immediate and automatic termination of the contract with the Manager, with all the consequences resulting therefrom.
ARTICLE 8
(USERS’ RIGHTS)
The Users have the right to fully enjoy the Co-work Space and other spaces made available and to use all infrastructures and services of common use installed in Golden Creative, according to the conditions established by the Manager.
ARTICLE 9
(USERS’ DUTIES)
GOLDEN CREATIVE ® CO-WORK & CREATIVE STUDIO
1 – Users of the Co-work space are obliged to comply with all the provisions contained in these Regulations and in the Contracts;
2 – The workstation is intended exclusively for the installation of the

3 – The workstation must be kept in good condition of use;
4 – The User will maintain with all other occupants, relations of good civic coexistence, not hindering in any way the use of common spaces and services, committing to guarantee
(a) the discipline of its staff, its contractors and its visitors, the normal and proper use of the common facilities;
b) That their staff, their contracted workers and their visitors do not exercise activities, other than the ones included in the development of the foreseen activities in the contract established between the company and Golden Creative
c) The respect for the hygiene and safety norms, relevant to the activities developed in the assigned facilities.
ARTICLE 10
(ACCESS TO THE Co-work SPACE AND OFFICES)
1 – Golden Creative’s opening hours are from 10 AM to 12:30 PM and from 2:30 PM to 6:00 PM, on working days;
2 – The access to the Co-work area is limited on Saturdays, Sundays and holidays and on working days from 8pm to 8am the next day;
3 – The restrictions on access mentioned in the previous point may, exceptionally, and with prior agreement between the parties be changed;
4 – Access to the Co-work space outside normal working hours is only allowed to employees of the Users installed there, properly identified;
5 – Smoking is forbidden in the offices and common spaces, in the terms of the Law;
6 – The Manager has the right to prevent the entrance of individuals who offend or cause any disturbance in the facilities;
7 – The Co-work Space is intended for the use and execution of administrative activities and services. Any use outside this scope or that implies floor overload or need for electrical power outside the common parameters for that type of activity, always requires prior and express authorization by the Manager;
8 – Authorization for placing advertising within the building is the exclusive responsibility of the Manager;
9 – The meeting room existing in Golden Creative for the use of “Co-workers”, clients of the Virtual Office service and respective clients or guests are available by appointment, taking into account the availability and according to the type of service contracted;
10 – It is recommended to all users of Golden Creative’s physical space the efficient use of common use equipment, light and water.
ARTICLE 11
(DEADLINE)
Co-work users, Virtual Office service users, Individual Desks and Open Offices will sign contracts for the use of the service(s) with Golden Creative for a period to be defined on a case by case basis, with the possibility of renewal. The contracts to be celebrated will have a minimum duration of 6 months.
ARTICLE 12
(RESOLUTION AND TERMINATION OF THE CONTRACT AND OF THE USE OF SERVICES)
1 – All obligations and enjoyment of the services made available by Golden Creative and respective contracts will be automatically terminated, when one or more of the following conditions is verified
(a) Failure to comply with any clause of this regulation or of the service provision contract entered into between the parties;
b) Failure to pay the Management of Golden Creative;
c) By initiative of the Manager, duly justified;
d) Improper behavior in the use of the services of common use.
2 – For the effects of paragraph 1, the Golden Creative’s Administration will communicate by e-mail the contract resolution and the termination of the services made available, producing all its effects from the date the e-mail is sent.
ARTICLE 13
(MODALITIES OF SERVICE AND PRICE LIST)
The modalities/types of service, as well as the price list associated to each type of service are published at Golden Creative’s website (www.goldencreative.pt).
Discounts and/or special conditions may exist for members or others, and this information is available at Golden Creative’s website (www.goldencreative.pt).
VI – APPLICATION AND SELECTION PROCEDURE ARTICLE 14
(APPLICATION)
1 – The application of an entity that wants to install itself in Golden Creative is formalized by filling out a form available on the website of Golden Creative, which must contain the following elements
a) Description of the activity it proposes to develop; b) Demonstration of its business added value;
c) Full identification of the company/applicant.
ARTICLE 15
(SELECTION)
1 – The evaluation of the applications is done by the Manager;
2 – The evaluation is done within 15 days of receipt of the application;
3 – The Manager may, at this stage and whenever deemed necessary, ask the applicant to provide more information or documents, as well as conduct an interview;
4 – The evaluation is performed in accordance with the criteria established in Article 16 of these Regulations;
5 – The result of the evaluation and selection process is communicated to the candidate by contact e-mail;
6 – A substantial change in the activity developed by a User determines the obligatory presentation of a new application.
ARTICLE 16
(SELECTION CRITERIA)
Applications will be selected according to the following criteria: 1 – Execution of innovative activities, research or technological development; 2 – Economic added value
3 – Suitability of the user;
4 – Job creation;
5 – Business and regional development potential;
6 – Technical, economic, and financial feasibility;
Registrations will be continuous, and priority will be given to admission according to the order of submission.
VII – FINAL PROVISIONS
The Manager is responsible for the compliance of these Regulations, as well as the maintenance, conservation and security of the facilities. Any cases not covered by these regulations will be resolved by the Manager.
ARTICLE 17
(FINAL PROVISIONS)
1 – Golden Creative will not be responsible in any case for the activity developed by the companies that use the Virtual Office service, by the Co-workers and users of other services, being only responsible for ensuring the maintenance of the conditions foreseen in this regulation for the development of its activity;
2 – The administration of Golden Creative can not be held responsible, civil or judicially, in any situation, for the breach of tax obligations, labor, welfare and social, commercial, financial, which constitute a burden of the “Co-workers” and users of Co-work services, Virtual Office, Office Rentals or any other available, before their suppliers, employees and any third parties;
3 – The cases omitted in this Regulation and the doubts in the interpretation of this Regulation will be resolved by the Manager.
